Each time President Trump issues an order, AND each time Elon’s team discovers more questionable (saying it kindly here) use of tax dollars within USAID (and other alphabet departments of bureaucracy) and attempts to cut off the “nonessential” spending and over-employed, the LEFT finds a judge who will then use his mallet to whack-a-mole Trump’s attempts to simplify and shrink government.

I do not believe our nation was ever intended to be RUN and managed by lawsuits and Executive orders. While we are to have a separation of powers within the three branches…. Those three branches are supposed to be working for the same outcome. LIBERTY… They are all three to be working within the constraints of the Constitution of the United States (a contract between We the People and the elected.)

Elon hired some computer geniuses all young, but of course, as his deputy posse to investigate fraud within the U.S. bureaucracy. Each time President Trump issues an order, whether it's an executive order or something else, and each time Elon's team discovers more questionable, saying it kindly there,

[00:03:53] use of tax dollars within the U.S. aid and other alphabet departments of bureaucracy, and attempts to cut off the non-essential spending and over-employed, the left finds some judge who then uses his mallet to whack-a-mole Trump's attempts to simplify and shrink government. I do not believe our nation was ever intended to be run by or managed by lawsuits and executive orders, but that seems to be where we are.

[00:04:23] And while we have separation of powers within the three branches, originally those three branches were supposed to have the same goal in mind, which would be liberty, freedom, independence. There are all three to be working within constraints of the Constitution of the United States, which is a contract between we the people and the elected.

[00:04:47] While many say all this chaos is in the courts by Democrats and their hand-picked judges is evidence that our system is working, I kind of disagree with that. We'll see what my guest says. I see it as them working against our system of government. But I'm just a simpleton at times. I do not believe things are all as complicated as they are lectured to us.

[00:05:13] As I said, I have a special guest with us this morning who I think can enlighten us on several issues. He was with us a few years back, and you've seen him on Newsmax and Fox. It's Hans von Spakovsky. I got it right this time, Hans. He's an American attorney and former member of the Federal Election Commission. He is the manager of the Heritage Foundation's Election Law Reform Initiative

[00:05:40] and a senior legal fellow in the Heritage Foundation's Miesk Center for Legal and Judicial Studies. I saw Hans recently. It had been a few weeks ago, and he was discussing the birthright issue, and that's what I wanted to talk with him about. But since that time, I have decided we're going to enlarge that discussion. So, Hans, welcome back to CSE Talk Radio. I hope you have your coffee ready because we've got a lot of discussion to do.

[00:06:08] I do. I have a cup sitting right in front of me. That's my kind of guy. That's my kind of guy. So, we're going to head into a break here in just a couple of minutes. But I do want to talk about the birthright citizenship. I do want to talk especially about these federal judges that are trying to stop President Trump's executive orders and everything he wants to do. And the Democrats just throwing hissy fits like three-year-olds.

[00:06:34] I want to discuss all those things with you, and I know you're a little bit more of a constitutional scholar than I am. But how do you see what's going down here just in a couple of minutes before we head into this break? Well, you know, it's interesting that the theme that the Democrats tried to run on, remember, during the election, was Donald Trump was a threat to democracy. But what is a threat to democracy?

[00:07:00] A threat to democracy is when you have a lone federal judge suddenly issuing orders saying that the President of the United States can't take certain actions in Washington, D.C. A lone federal judge, for example, in New York. Yeah, and they just, you know, I used the whack-a-mole this morning because that's how I see them. Every time Trump does something, they try to whack it out, you know. Excuse me.

[00:07:30] They just try to stop him from everything he's wanting to do. And he's wanting to do what the people want him to do. But the Democrats kind of ignore the will of the people, don't they? Well, they do. But these judges are also ignoring the law. They are not acting according to the rule of law. In fact, what they are doing, again, like this judge in Manhattan, Paul Engelmeyer,

[00:07:53] is he clearly is acting as if he is a super legislator who can simply overrule what the president says, no matter that he doesn't have any law to support what he's doing. No, and, you know, it seems to me, and I'm going to back up here just a little bit, the immigration laws, they keep talking about Trump's immigration policies, but his policies are trying to pull us back into the immigration laws,

[00:08:22] which were written and approved by Congress. Maybe not the sitting Congress today, but those laws are there. And they're acting like Trump's just making this stuff up. And it just, it's kind of like, you know, nails on a chalkboard every time they say that. And it's, so they're the ones that are really breaking the law. Biden was breaking the law at every turn. We have too many immigrants that have come in here, illegal aliens, I call them, that are in here, in this country.

[00:08:51] Many of them are terrorists. Many of them are known murderers, rapists, cartels, gangs. They're just horrific. And we got to get them out of here. And so I wanted to talk about all of this this morning. So hang on, because I really, let's concentrate on this bureaucracy. And when we come back, and we're just going to hit the ground running here, because there's so many topics I want to discuss with you, Hans.

If you remember, Hans, I could not get your name right the last time you were on, so I've been practicing. I couldn't have you on until I could do it right. Well, you're doing great. Thank you, thank you, thank you. Well, I'm excited to have you here. I want to talk about a lot of things. And, you know, they keep talking about Trump being the chaos. I don't see Trump as the chaos.

[00:13:32] They go ballistic and chaotic every time he tries to do something. And I'm one of those people out here that I wished we didn't have to run this country by lawfare, lawsuits and executive orders. I don't think that's the way it was intended. But that's where we are today. And I'm going to let you elaborate on that a little bit. And then I do want to get back on these federal judges because they're whack-a-mole at everything that Trump does.

[00:14:00] Because that has got to be chaos and unconstitutional. And I'm going to just hand it over to you right there. Well, let me say something about executive orders. What the president has done with executive orders is perfectly constitutional because he's not trying to order around, for example, state and local government. His executive orders are directed at the executive branch. Yes.

[00:14:27] He is, for example, telling the Department of Homeland Security, you will enforce our immigration laws. There's nothing unconstitutional about that. But he's doing what he's supposed to do as the constitutional head of the executive branch. And it really is astonishing. But, boy, it tells you a lot, doesn't it? Yes. It does. Exactly where we're at that we have to put an executive order out there to tell everybody to obey the law.

[00:14:57] Yeah. Isn't that just astonishing? It tells you how far we've got. But, look, here's the other thing that tells you so much about the poisonous atmosphere of Washington and how out of control the gigantic bureaucracy of the federal government is, is that what are they getting upset about?

[00:15:17] Well, the fact that you have someone like Elon Musk and people with him exposing, creating transparency, for example, for USAID and who they've been sending our taxpayer funds to. They're upset over the fact that they're publicizing who the money has gone to. Yes. And, you know, it brings me back. I get tired of this bureaucracy.

[00:15:47] They call it the swamp. But I think the bureaucrats have been who's running this country a lot. Yeah. And they're making law by, if they call them, like regulations and mandates and fines and permits and licenses. Those are all taxes, in my view. But I go back to the Declaration of Independence. I know that you love it. I love it, too. But the 10th grievance, which is my sidekick here, Rudy, it's his favorite.

[00:16:17] He'd never heard of it until I read it. But they're talking about the king. But let's talk about whether it's a president or it's Congress that has erected the multitude of new offices and sent hither swarms of officers to harass our people and eat out their substance. And I see that as what the swamp is today, with the bureaucratic swamp that we have, that believe that they could tell a president of the United States how he's going to run this country.

[00:16:45] Listen, as soon as you mentioned the Declaration of Independence, I knew that was the part of it you would pick, because I agree entirely with you. Well, we're on board then, aren't we? Well, you know, and I kind of feel like when we go through and we read those grievances, I can see those same things that are actually happening today in different ways.

[00:17:13] Of course, we're not in the same era as we were back then. But these bureaucratic offices, I see them as this 10th grievance. And I think I kind of, you know, these grievances that were on the Declaration of Independence were just the beginning. And the Declaration of Independence was not just for them to tell the king, because the king was already aware of their problems. They were telling the entire world.

[00:17:40] And I kind of feel like that's what we did here in the United States November 5th. We're telling the entire world we are independent and we're not going to live like this anymore. And we want Trump to clean it up. And bless his heart, he's doing his very best. And I think he's wearing everybody out. Yeah, no, look, you're right about that.

[00:18:00] And what people need to understand is the federal government today has far more power than the British monarchy that we fought a revolution against. And I think the best example of this I've ever read, this was by a federal judge who back when Obamacare was implemented, there was a federal judge who issued an injunction against it.

[00:18:26] And he said in there, to talk about why it was unconstitutional was, and why the federal government today has more power than the British monarchy is. Listen, the revolution in part was about the fact that Americans didn't want to pay the tax, right? Yes. That they were putting on tea.

[00:18:49] Well, why would they have put a tax on tea if, in fact, the monarchy could have simply said everyone has to buy the tea? Which is exactly about the same thing with Obamacare. You have to buy this insurance. We have to buy that insurance. It's the same thing with automobile insurance. You have to get it. You have to get a license and you have to have automobile insurance. Yes.

[00:19:15] And so I see it, Hans, as our legislators up there with the lobbyists and they're cutting these deals. And what better way than to say, okay, we're going to invest in this and we're going to force the American people to buy this. So yesterday it was against the law. It was not against the law. It was legal. And today, if you don't do it this way, then all of a sudden it's against the law.

[00:19:39] And they're just playing havoc up there, whether it's the federal judges or even our legislators and whoever's president sometimes. Now, we know Biden, he wasn't doing any of that. It was the bureaucrats and some of those behind the scenes. A lot of people think it was Obama, and I think he had a lot of influence in there. But talk about – I know they use the word democracy. I like the word republic, constitutional republic.

[00:20:06] But talk about breaking what we are and going against the Constitution. That's what they did. And they got away with it, basically. Don't you think? Think about the protests you're seeing going on right now by federal employees just over the fact that they're being told they actually have to show up at their offices.

[00:20:31] You know, but look, we laugh about it, but that is a symptom of just how bad things are in Washington, how bloated and overgrown the federal government is, and how powerful these bureaucrats are that inhabit all of these agencies. And who thinks that they should be able to act independently and not listen to what the president tells them?

[00:21:00] Well, let's – when I saw you, and I think it was a couple of weeks ago, and I told Rudy we need to get Hans back on. You were talking about the birthright citizenship. Now, I read something several years ago, and I mean, I think it was during Reagan's administration, and it was by Phyllis Schlafly. And she says it's absurd to think that this was put down on the paper, our amendment, the 14th Amendment, that anybody who crosses the border drops a baby and they're automatically a citizen.

[00:21:30] She said that was never the intention of it. And common sense tells us that. Yet they are fighting this tooth and toenail. I don't think it's just for votes. That's just my opinion. I think there's something a little more nefarious going on. Yeah, they want votes. But what's your opinion on this birthright citizenship? How should we go about – I said maybe we just need to define it more than what it is. But what do you think?

[00:21:58] Well, Trump has really taken the step needed to finally resolve this issue. He basically issued, as you know, an executive order to all federal departments, in particular the State Department, saying you will apply the 14th Amendment as originally written and intended.

[00:22:21] And that means that when you apply for a passport, you not only have to show you were born in the United States, but that at least one of your parents was either a U.S. citizen or a permanent resident alien. If you are – if you can't show that, you're not a U.S. citizen. That case is going to go all the way to the U.S. Supreme Court.

[00:22:45] Yes, there have been injunctions already issued by liberal activist judges in multiple states. But if the Supreme Court applies the 14th Amendment as it was passed, if they look at what the sponsors of the amendment said, and if they look at Supreme Court precedent on this, they will rule in Trump's favor. And that will finally resolve the matter.

[00:23:11] All right. Well, I hope so. I have a few judges I'm concerned about there that I don't think they look at the original intent. I think they have an agenda. We have with us today Hans von Spakovsky, and we are excited about that. We're just kicking around some things right now. Constitutional. We're not kicking the Constitution around. We're trying to understand things. I think the Constitution is pretty simple, but, you know, just like anything else,

[00:28:21] you start getting committees and you start getting this and stuff in church or any other organization, and all of a sudden it gets complicated, and I think they're making it out to be more complicated than our founding fathers ever intended it to be. We were talking about the birthright citizenship as we went into that break, and I mentioned just as we edit out that I'm concerned about a couple of the judges on the Supreme Court

[00:28:45] because I think they don't necessarily think about originality or original intent of the Constitution, and I'm just going to get your opinion on that. We don't have to name names. Well, look, if the birthright citizenship case gets the Supreme Court, which I think it will, the three liberal judges on the court, we know exactly how they'll vote, right? They are 100% predictable.

[00:29:12] They always vote not based on the Constitution or the law but on their ideology, and that is clear from their time on the court. The six other judges, look, there are certain judges who always vote the correct way. There's one or two, including the chief justice, who often votes the right way,

[00:29:39] but there are times, sometimes on major cases, where he just does the wrong thing. And, of course, the Obamacare case is the worst example of that when he was a deciding vote that said, yes, it's constitutional to force Americans to buy insurance, which is just a ridiculous concept. So, yeah, he's a problem.

[00:30:05] On the other hand, this birthright citizenship issue, look, there's three prior Supreme Court cases on this. Okay. They're all very old. The last one was almost 130 years ago. But if he follows that precedent of those three cases, again, Donald Trump will win this case. We like winning, as Donald Trump likes to say. We like winning. I'm not tired of winning yet.

[00:30:32] But I noticed that this morning, and I have not read the article, but Christine Ohm fired four people from FEMA for giving $59 million, I think, to the hotels there in New York. Let's see. All right. To house the legal alien. Yeah. Yeah.

[00:30:57] Well, you know, well, North Carolina is in a bad way, and we can't seem to get the money to help them. We've got money for every other thing, everybody else, every foreign country, but we don't have money for them. And that irritates me. I'm from the Midwest. I'm sitting right here. You're talking to somebody that's right smack dab in the middle of Missouri. And we are definitely the flyover state for sure.

[00:31:25] And, yes, we were sad on Sunday. But we'll get over it because that's the way we do here in Missouri. We get over it. We move on. We push forward. But, you know, it's exciting to see that they're actually carrying that out. Nobody would have ever fired anybody before. I don't think people are used to getting fired in the government, are they? No, they're not at all. And that is a real problem. And, in fact, it should be happening a lot more.

[00:31:53] You know, the staff, the number of employees in the federal government is bigger than the population of multiple states. That is a bloated federal government. That is a bloated bureaucratic staff. And there need to be major cutbacks in almost every federal agency. Probably the only exception I would say to that is the Department of Defense. Yes.

[00:32:20] But all these other departments need major cutbacks. The Department of Education ought to be eliminated entirely. I agree. The Department of Defense still needs to be audited. I think every single department should go through maybe an annually audit because we just don't know. We out here in the heartland, we don't know how they're spending all those tax dollars. And we don't like them spending them like crazy people. We don't have the money to do it.

[00:32:49] And yet it is our tax dollars. In fact, it's our grandchildren and our great-grandchildren's tax dollars because we're in debt. And they keep telling us we can't get out of debt. Well, they won't stop the spending. And that's coming up again here on March 14th, I believe, is the deadline once again, Hans. And I found out this morning, bless their little hearts, that our Congress wants a raise.

[00:33:17] And I'm thinking these guys don't get it. It's not time for a raise. They want more staffing instead of less staffing. And they want a raise. So I'm going to grab your opinion on that. I'm insulted by it. All this we're going through with Doge and our Congress says they want a raise.

[00:33:36] Well, I guess my view on that is that they can and should consider it if and when they actually enact major cuts in the actual federal budget. Amen. If they can show that they're successful. By the way, you know, by proposing an audit for these government agencies, why, that makes you a threat to democracy. I know. But I don't believe in democracy.

[00:34:04] I believe in a constitutional republic. Yeah, we do. But that's the word of the times. I know. I am a threat. I've done a lot of things. I've read that Declaration of Independence so many times. And I rewrote it using Congress's name instead of the king because I was so aggravated at them several years ago for the things they were doing when they were going after Trump in the first administration.

[00:34:32] And I was just as angry with the Republicans as I was the Democrats. And I still am a little bit. I don't trust them. I'm just going to say it out loud. I do not trust them. Well, you shouldn't. And look, for folks who haven't looked at it, they should look at the list of funding that USAID sent abroad. Compare that to the problems North Carolina has had in getting funding.

[00:35:02] And you will see why the left is so intent on hiding this. I mean, $1.5 million they gave to advance DEI in Serbia. $70,000 for production of a DEI musical in Ireland. $47,000 for a transgender opera in Colombia.

[00:35:29] That is how your taxpayer money is being used. And the left doesn't want you to know that. Well, I'm going to ask a question. Do you think that money really went there? Or do you think it went somewhere else and that was just a funnel? Oh, no, I think the money went there.

[00:35:47] But on the other hand, we do know that there are hundreds of thousands of dollars that also went to certain nonprofits abroad that are linked to designated terrorist organizations. Yes. Yes. What was it that they sent and that was going to be used for digging tunnels in Gosset? It's like, wait a minute. That doesn't make any sense.

[00:36:14] And I don't understand, you know, unless the left are truly, and I know I'm not supposed to say this, the enemy of our state, the enemy of the United States of America. Why are they doing these things if they're not? I don't. I don't.

[00:36:33] Well, look, it's very clear when you look at the things they do, the things they say, the social media posts they put on, that many of them truly believe that America, our culture, our history is the enemy of the world.

[00:36:49] That we are an imperialist power that needs to be destroyed or everything internally broken up so they can recreate us in what their version is of utopia. I had a boss, Derry Brownfield, very famous in the agriculture business, and he had a talk show, and I worked for him on his talk show. But he's the one who founded the Brownfield Network.

[00:37:16] In fact, when he passed away, Hans, they had a moment of silence in Congress for him. But he used to say, talking about the new world order, the globalism, that they have to bring America down to a third world status because they can't bring the rest of them up. And that's the redistribution of wealth, and that is the destruction of America and our independence, our sovereignty for a global agenda. And I'll leave it at that because we're headed into the break.

And we are enjoying our time with Hans von Sposkowski, which I get it right part of the time. I don't know what happens to me, Hans, but you'll have to forgive me. Nobody can pronounce my last name anyway. It's Schoenberg. You know, when we have these Irish names, people have a little trouble with them.

[00:42:29] But anyway, we are excited that you're here and appreciate it so much, all the work that you do, enlightening us. I know you've done a lot of studies on the Constitution and such. I feel like we are. You heard my commercial on the American crisis. Thomas Paine's one of my faves. And I believe we will always be in America in a crisis of some sort because there's always somebody who wants to strip your liberty. Always.

[00:42:59] There's always that shyster, whether it's in our Congress or some foreign entity. There's always going to be somebody who wants to take it away. And I've told my listeners. And last time we talked, we talked about election integrity. But I've told my listeners that, okay, you voted in November, but you can't vote and walk away. You've got to be involved. You've got to stay connected. You've got to understand what's happening. And we need to be Trump's backup.

[00:43:29] And I'm always giving the Congress phone number out. You know, call them and tell them what you think. If they did good, pat them on the back. And if you don't like what they're doing, tell them, knock it off. Anyway, that's where I sit on some of that. Well, look, you're absolutely right. And like on the election integrity issue, now is the time to strike while the iron is hot. Amen. The state legislatures are in session right now all over the country.

[00:43:57] And we need to continue to try to improve the laws governing elections in states all over the country before the next elections, which, you know, the congressional elections are going to be coming up in a very short amount of time. Yes, very fast. And right now, Republicans have a negligible margin in the U.S. House.

[00:44:25] They cannot afford to lose control of the U.S. House. And that means that's something folks ought to be working on right now. Yeah, I mentioned that earlier this week or last week. You know, Ken, I'm going to ask – I'm going to pick your brain here because you're Mr. Knowledge to me. There's some things about our election that I think maybe should be federally mandated. Am I wrong in that, like the use of paper ballots and that kind of thing?

[00:44:53] Is it wrong to think that that should be the same across the nation? Yeah, the problem is that for everything that one Congress could do that might be good, another Congress taken over by Democrats, if it's a national mandate, they could do things that are bad. And that's the danger.

[00:45:18] Yeah, the state system we have means that some states actually are doing a very good job at this. Florida is a good example of that. Yes. Missouri has made many improvements. States like New York, California are bad, but would you rather have California and New York-style elections everywhere?

[00:45:38] And remember, when Nancy Pelosi was still the Speaker of the House, they tried to get through a bill, H.R. 1, that would have nationalized and taken over elections all over the country. And one of the most prominent features in it was a provision that would have outlawed all state voter ID laws. So that's the problem with that.

[00:46:02] The federal government should assist the states, but if you put in mandates, eventually it's going to come back to bite you. All right. I kind of agree with that. It seems to me we ought to be able to simplify it and make it the same. They can make other things different in that. But if we had it the same as far as paper ballots and IDs, I'm a believer in IDs. You have to show them for everything else.

[00:46:33] You know, they lied to us about our Social Security number. Mine is so old it still says cannot be used for identification. But the new ones don't say that. And, you know, so I can see where that would blow up. It could blow up in our faces, and we don't need that. We don't need that at all. But we do need election integrity.

[00:46:56] And, you know, a lot of these things we talk about, Hans, they start at home, having integrity in the home, you know, having an understanding about the Constitution. And I encourage my listeners to read that Declaration of Independence because I just think it's an awesome statement. And it inspires me. And I love to read Thomas Paine. I love to read that. So, I don't know. I just, I'm worried about our country.

[00:47:26] I think we're in the, we have a little air of excitement going on right now. But I don't like these whack-a-mole judges. Well, I don't either. But, listen, we are in a much better position today than we would have been if Kamala Harris was today the president. I think it would have been the end of our United States of America as we knew it. I do. I agree. I do. I do.

[00:47:54] And, you know, they, I don't know if kids still have to study the Constitution in order to pass. We had to pass it in high school before we could get our diploma here in the state of Missouri. And I don't know if they still do that or not. But it meant a lot to me when we studied that as a kid. Did you do that? I know you're a little bit younger than I am. So, yeah, of course I did. But I don't think that's, I don't think that's a requirement anymore. It should be. But I don't think it is. It should be. It definitely should be. Maybe we could suggest that.

[00:48:24] Whisper in Trump's ear. Make that an executive order. I'm just kidding. We can't have everything as executive orders. But I appreciate you taking the time with us today, Hans. If you've got a little message you want to encourage my listeners, do that now. I'm going to give you this. We only got a couple minutes left here in the show. Well, the thing, again, I would just tell them, get involved. You know, talk to your state legislator. They're easy to usually reach and talk to.

[00:48:53] Whoever represents you and make sure that they are working on the issues that are important to you. Everything from making sure that athletic teams in your public high schools require girls to be girls and boys to be boys to participate. That's just a very basic thing that you can be involved in.

[00:49:19] You can be involved in talking to your legislator about making sure does your state have a voter ID law. If not, be sure they put one in. It's that kind of thing. Very simple. That will help make this a better place. I'll tell you right now. When those little girls with the little bows in their hair stood around President Trump as he signed that executive order, I teared up. I really got emotional. And when I went home, I told my husband, did you see that? He said, yes.

[00:49:48] I said, I actually teared up. He said, I had to fight back a tear also. It is amazing what's happening in this country. And Hans, you've had a lot to do with it. You've been a voice of reason. And we appreciate you so much. And I hope you'll come back again. Maybe we can concentrate on one topic. And Beth won't be so chatty, but that's probably not possible.
